TRAVEL AND PAYMENT TERMS as of: September 2021
The following travel conditions apply to package travel contracts to which the provisions of §§ 651 a ff BGB apply directly to the travel contract. The provisions, if effectively agreed, become the content of the package travel contract concluded between the customer and the tour operator. They supplement and complete the legal provisions of Sections 651 a to y BGB and Articles 250 and 252 EGBGB.
When booking a package tour, the contractual partner of the tour operator is the traveler – it is irrelevant whether the traveler uses the package tour himself or he concludes the contract for another travel participant. These General Terms and Conditions expressly do not apply if the traveler is not on a package tour within the meaning of §§ 651a ff. BGB, but only book individual travel services (e.g. hotel only, rental car).
Validation: Custom proposals have a validation period of 14 days after issue.
1. Conclusion of the travel contract
By registering your trip, you are offering Patagonia NWT UG to conclude a travel contract. Registration can be made verbally, in writing, by telephone, fax or email. The travel contract is concluded when we accept your registration and will be given to you with the travel confirmation as confirmation of the contract on a durable medium (e.g. by email, paper form: only in accordance with Art. 250 § 6 Para. 1 Sentence 2 EGBGB ).
The customer must be responsible for the participants listed in the registration as well as for his own contractual obligations, provided he has assumed this obligation by express and separate declaration.
2. Payment and cancellation conditions
Upon confirmation we require a deposit of 30% and six weeks before departure the remaining 70%. This rule does not apply to flights, which must be paid for upon confirmation.
Cancellation by the traveler, rebooking, replacement persons
The customer can withdraw from the travel contract at any time before the start of the trip. The decisive factor is the receipt of the declaration of withdrawal by Patagonia NWT UG. It is recommended that you declare your withdrawal in writing for reasons of proof.
If the customer withdraws, Patagonia NWT UG loses the right to the agreed travel price, but can demand appropriate compensation. For this purpose, Patagonia NWT UG has determined the following flat rate compensation, which is based on the period between the declaration of withdrawal and the start of the trip, the expected savings in expenses from Patagonia NWT UG and the expected acquisition through other use of the travel services and as a percentage of the travel price, based on the point in time of the customer.
In the event of cancellation by the customer/passenger, the following costs will be charged:
- In case of cancellation one week to one day before arrival: 100% of the total amount
- In the case of booking special services and / or accommodation, cruises and / or flights, other cancellation rules may apply. You will be informed of this at the moment of the offer and / or when the invoice is sent.
- In case of cancellation one day before arrival: 100% of the total invoice amount.
- When canceling domestic flights, bus and/or ferry tickets, 100% costs will be charged, regardless of the time of cancellation.
- Different cancellation policies may apply for special incentive programs/accommodations; these will be specified in the special incentive proposal.
- When canceling after payment of the deposit 5% will be charged as a fee.
The customer is always at liberty to prove that Patagonia NWT UG suffered no damage at all or only incurred a significantly lower amount than the flat rate. We recommend you get travel cancellation insurance.
Rebookings, d. H. Changes to the travel date, the travel destination, the accommodation or the type of transport are generally only possible after withdrawing from the travel contract (cancellation) in accordance with the aforementioned cancellation conditions and with simultaneous new registration. The customer has no legal right to rebooking.
The customer can declare within a reasonable period of time before the start of the trip on a durable medium (e.g. by email) that a third party will take over the rights and obligations from the travel contract instead of him. The declaration is in any case timely if it is received by Patagonia NWT UG no later than seven days before the start of the trip. Patagonia NWT UG can object to the entry of the third party if this third party does not fulfill the contractual travel requirements. If a third party enters into the contract, he and the customer are jointly and severally liable for the travel price and the additional costs arising from the third party’s entry. Patagonia NWT UG may only demand reimbursement of additional costs if and to the extent that these are reasonable and actually incurred by it. It must provide the guest with proof of the amount of additional costs incurred as a result of the third party’s entry.
3. Services
The scope and type of the contractually agreed services result from the service description of the offer for the trip in question and all the information and explanations contained therein in conjunction with the individual travel confirmation.
4. Price and contract changes after conclusion of the contract, significant contract changes
Patagonia NWT UG reserves the right to unilaterally increase the travel price after conclusion of the contract if the increase in the travel price results directly from an increase in the price for the transport of people due to higher costs that actually only occurred after the conclusion of the contract and was not foreseeable when the contract was concluded, fuel or other energy sources, an increase in taxes and other charges for agreed travel services, such as tourist taxes, port or airport fees, or a change in the exchange rates applicable to the package tour in question. In the cases mentioned, the travel price will be changed to the extent that the increase in the factors mentioned in person affects the travel price. If this is the case, Patagonia NWT UG will immediately inform the customer clearly and comprehensibly about the price increase and its reasons on a durable medium (e.g. by email) and will inform the customer of the calculation of the price increase. A price increase is only effective if it meets the requirements stated here and the customer is notified no later than 20 days before the start of the trip. A price increase that is requested from the 20th day before the agreed departure date is ineffective. Patagonia NWT UG’s obligation to reduce prices according to 4 is expressly pointed out.
Since 4 provides for the possibility of an increase in the travel price, the customer can request a reduction in the travel price if and to the extent that the prices, duties or exchange rates mentioned in 4 have changed after the conclusion of the contract and before the start of the trip and this leads to lower costs for Patagonia NWT UG. If the customer has paid more than the amount owed hereunder, the excess amount must be reimbursed by Patagonia NWT UG. Patagonia NWT UG may deduct the administrative expenses it actually incurred from the additional amount to be reimbursed and, upon request, must provide the customer with proof of the amount of administrative expenses incurred. Patagonia NWT UG reserves the right to unilaterally change contractual conditions other than the travel price after conclusion of the contract if the changes are insignificant, do not affect the overall nature of the booked trip and are not brought about contrary to good faith (e.g. in the case of flight times or route changes). . Patagonia NWT UG must inform the customer about the change on a durable medium (e.g. via email, SMS) in a clear, understandable and prominent manner. The change is only effective if it meets these requirements and is declared before the start of the trip.
Significant contractual changes: If the price increase reserved in 4 exceeds 8% of the travel price, Patagonia NWT UG cannot implement it unilaterally. Patagonia NWT UG can, however, offer the customer a corresponding price increase and demand that he (1) accepts the price increase offer or (2) declares his withdrawal from the contract within a period determined by Patagonia NWT UG, which must be reasonable. The offer to increase the price cannot be made later than 20 days before the start of the trip. If Patagonia NWT UG can cancel the trip due to a circumstance that occurred after the conclusion of the contract, only with a significant change in one of the essential characteristics of the travel services (Art. 250 § 3 No. 1 EGBGB) or only with a deviation from special requirements of the customer, which have become part of the contract, provide, then sentence 2 of this section 4 applies accordingly, i.e. H. Patagonia NWT UG may offer the customer the corresponding other contract change and require that the customer (1) accept the offer to change the contract or (2) declare his withdrawal from the contract within a period of time determined by Patagonia NWT UG, which must be reasonable. The offer for such other contractual changes cannot be made after the start of the trip.
In its offer for a price increase or other contractual change according to 4, Patagonia NWT UG can also optionally offer the customer participation in another package trip (substitute trip), about which Patagonia NWT UG must inform the customer in accordance with Art. 250 § 10 EGBGB.
After the expiry of a period specified by Patagonia NWT UG after 4, the offer to increase the price or make other changes to the contract is deemed to have been accepted.
If the customer withdraws from the contract after 4, Section 651h Paragraph 1 Sentence 2 and Paragraph 5 BGB applies accordingly. As far as Patagonia NWT UG is concerned as a result of the customer’s withdrawal. If the travel price is to be refunded, Patagonia NWT UG must make payment immediately, in any case within 14 days of the cancellation. The customer’s claims according to Section 651i Paragraph 3 No. 7 BGB remain unaffected.
5. Limitation of Liability
The contractual liability of Patagonia NWT UG for damages that do not result from injury to life, body or health is limited to three times the travel price, provided that these were not caused culpably. If international agreements or legal regulations based on them apply to a travel service, according to which a claim for damages against the service provider arises or can only be asserted under certain conditions or restrictions or is excluded under certain conditions, Patagonia NWT UG can also make a claim against the service provider Travelers refer to this.
Patagonia NWT UG is not liable for service disruptions, personal injury and property damage in connection with services that are only provided as third-party services, such as excursions, sporting events, theater visits, exhibitions, if these services are expressly stated in the travel description and the booking confirmation and with details of the identity and The address of the contractual partner referred to must be clearly marked as third-party services so that the traveler can see that they are not part of Patagonia NWT UG’s package tour. However, Patagonia NWT UG is liable for these services if and to the extent that damage to the traveler was caused by a breach of information, information or organizational obligations on the part of Patagonia NWT UG.
Patagonia NWT UG is not liable for services used by the traveler as part of the package tour and which are not arranged or organized by Patagonia NWT UG or its local representatives, but, for example, by the hotel or other persons or companies on their own responsibility.
6. Services
Accommodation
Please note that South American hotels may have a different star rating than in your home country. Hotels mentioned in the itinerary are subject to change at the time of confirmation as they are subject to change based on availability. Upon arrival, the hotel may ask you to provide a valid credit card and hand over your passport as a guarantee so that the hotel can make a copy.
Transfers
Patagonia NWT UG work with normal four-passenger cars for transfers. We charge one large suitcase and one small bag per person (airline measures). If more luggage arrives, Patagonia NWT UG must be informed and additional charges may apply.
Rental car
Patagonia NWT UG cannot be held responsible for any issues regarding the size of the rental car. Car rental categories can be changed on the Hertz website (https://www.hertz.com.ar/en/vehicles) (applicable to rental cars in Argentina only). If the rental car is picked up or dropped off outside of office hours or at hotels/airports, credit card information and a copy of your driver’s license will be required upon booking. When picking up the rental car, a valid credit card must be provided by the passenger.
Excursions/tours
All (optional) excursions/tours are exclusive of lunch, snacks and (national park) entrance fees unless otherwise stated in the tour offer. Regular (optional) excursions/tours are offered with an English-speaking guide (bilingual guide) or with a Spanish-speaking guide. Private (optional) excursions/tours are always accompanied by Spanish speaking guides and have an additional fee for a bilingual English (or other languages) speaking guide. In the event that booked excursions/tours cannot be carried out or a change is required and/or cannot be carried out due to climatic reasons, a refund is not possible. There is never any guarantee that wild animals will be discovered at the destination. If excursions are not booked in advance, passengers can book excursions at the destination by contacting the local provider (contact details are included in the travel vouchers).
Flights
Domestic flights can most likely be arranged more cheaply in conjunction with the international flight using an Airpass from the destination. If flights are included in the offer, consider them as example flights; Flight times and prices may therefore change. The flights cannot be booked and the tickets printed out before Patagonia NWT UG has received full payment for the flights offered on their account. Up to this point, flight prices, times and availability are subject to change. In the event of cancellation or if changes are required: once issued, 100% cancellation fees will apply.
Bus and ferry tickets
Bus and ferry tickets can only be issued one month before the travel date. The seat type (Cama / Semi-Cama) or the departure and arrival time can be guaranteed until the final issue price and availability. Only after Patagonia NWT UG have received the full quota payments on their account can the tickets be booked and the tickets printed. Until then, prices, times and availability are subject to change. In the event of cancellation or if changes are required: once issued, 100% cancellation fees will apply. It may happen that current tickets have to be picked up locally at the bus company’s office. You will be informed about this before your trip and/or in your voucher.
Terms and Conditions
- Itineraries are based on the availability of hotels and services at the time of final reservation. If a hotel or service is unavailable, Patagonia NWT UG reserves the right to offer an alternative in a similar category and price range. In the event of a higher price, the passenger must cover the difference. Hotels/providers can still implement price changes; therefore prices may change if reservation and deposit are not made.
- Itineraries do not include (national park) entrance fees unless otherwise stated in the offer.
- Prices are expressed in USD
- Upon arrival in Buenos Aires, the passenger will receive an information pack containing travel information, Buenos Aires city map, vouchers, bus/flight/ferry tickets and directions if applicable.
- If the passenger wishes to make changes to the itinerary while already in South America, additional costs must be borne by the passenger himself.
- Drinks are not included in meals as standard.
7. Complaints, remedies, setting a deadline before the customer cancels
The customer must report any defects immediately to the office named in the travel confirmation or to the local Patagonia NWT UG travel agency or at the address/telephone number listed below and request remedial action there within a reasonable period of time. If the customer culpably fails to report and Patagonia NWT UG was unable to remedy the situation as a result, the customer is not entitled to assert the rights specified in Section 651m of the German Civil Code (BGB) or to demand compensation for damages in accordance with Section 651n of the German Civil Code (BGB). If the customer demands remedial action, Patagonia NWT UG must remedy the travel deficiency. Patagonia NWT UG may refuse to provide remedy if it is impossible or involves disproportionate costs, taking into account the extent of the travel deficiency and the value of the affected travel service. Patagonia NWT UG can remedy the situation by providing replacement services of equal or greater value. If Patagonia NWT UG can refuse to remedy the defect and the defect affects a significant part of the travel services, Patagonia NWT UG must offer remedial action through appropriate replacement services.
If a trip is significantly impaired as a result of a defect and Patagonia NWT UG does not provide remedial action within the reasonable period set by the customer for remedial action, the customer may terminate the travel contract, although a written declaration is recommended for reasons of proof. There is only no need to set a deadline before termination if Patagonia NWT UG refuses to provide remedy or if immediate remedy is necessary. If the contract is terminated by the customer, Patagonia NWT UG retains the right to the agreed travel price with regard to the travel services provided and those still to be provided at the end of the package tour; The customer’s claims according to Section 651i Paragraph 3 Nos. 6 and 7 BGB remain unaffected. With regard to travel services that can no longer be provided, Patagonia NWT UG’s claim to the agreed travel price no longer applies; Any payments already made must be reimbursed to the customer by Patagonia NWT UG. Patagonia NWT UG is obliged to take the necessary measures as a result of the cancellation of the contract, in particular, if the contract includes the transport of the customer, to immediately ensure his return transport; The means of transport used for this must be equivalent to that agreed in the contract. The additional costs for the return transport will be borne by Patagonia NWT UG.
8. Termination of Patagonia NWT UG
If the traveler causes a lasting disruption despite a corresponding warning from Patagonia NWT UG or if he behaves in breach of contract to such an extent that it is unreasonable to continue the contractual relationship with him until the agreed termination or expiry of a notice period, or if he otherwise severely breaches the contract, Patagonia NWT UG can do so without Terminate the travel contract within a deadline. Patagonia NWT UG retains the right to the travel price less the value of saved expenses and, if necessary, reimbursements from service providers or similar advantages that it obtains from the other use of the unused service. Any additional costs for return transport are borne by the person causing the disruption.
9. Carrier Identity
When booking, Patagonia NWT UG informs the customer about the identity of the respective air carrier for all air transport services to be provided as part of the booked trip. If the airline(s) carrying out the flight has not yet been determined at the time of booking, the airline(s) that will probably carry out the flight must be named and Patagonia NWT UG must immediately ensure that the customer is immediately aware of this the identity will be given as soon as it is established. The same applies if the operating airline changes.
10. Passport and visa requirements, health regulations
Before concluding the contract, Patagonia NWT UG will inform the customer about the general passport and visa requirements of the destination country, including the approximate deadlines for obtaining visas and health formalities (e.g. police-required vaccinations and certificates) required for the trip and stay.
The customer is responsible for compliance with the regulations. All disadvantages, in particular the payment of cancellation costs, that arise from non-compliance with these regulations are at his expense, unless Patagonia NWT UG has not fulfilled its pre-contractual information obligations or has fulfilled them poorly. In particular, customs and foreign exchange regulations abroad must be adhered to. The customer is responsible for obtaining and carrying the necessary travel documents and must ensure that his passport or identity card is sufficiently valid for the trip. If the customer has commissioned Patagonia NWT UG to apply for official documents, such as a visa, Patagonia NWT UG is not liable for the timely issuance of these documents by German or foreign authorities, but only if they violate its own obligations and even those caused the delay.
11. General
The ineffectiveness of individual provisions does not result in the invalidity of the entire travel contract. German law applies exclusively to the entire legal and contractual relationship between us and the customer. The European Commission provides an online dispute resolution (OS) platform for the out-of-court settlement of consumer disputes for travel contracts concluded via electronic legal transactions, which guests can find at http://ec.europa.eu/consumers/odr. Patagonia NWT UG does not take part in any dispute resolution proceedings before a consumer arbitration board and is not legally obliged to participate. There is no internal complaints procedure.

Data protection notice:
The personal data provided by travelers when booking the package tour is processed electronically and used by Patagonia NWT UG and its service providers (transport companies, hotels, incoming agencies, database providers for entry and health regulations) and in the reservation system used worldwide (GDS ) processed and stored to the extent that they are necessary for the execution of the contract. Due to a US federal law on terrorist detection, airlines are forced to provide the flight and reservation details of each passenger to the US Transportation Security Administration (TSA) before entering the US. Without this data transmission, entry into the USA is not possible – this also applies to stopovers and connecting flights. This data must also be transmitted for flights to other countries that only affect US airspace.
The regulations of the GDPR apply. The detailed data protection information, including the rights of travelers, is stored on Patagonia NWT UG, can be requested using the contact details of Patagonia NWT UG or is made available at the time the data is collected (travel inquiry / travel booking).
